Everlytic (Pty) Ltd (“Everlytic”) wishes to recognise excellence in email marketing skills and showcase the creative organisations that demonstrate such skills. Everlytic has therefore designed the “You Mailed It Email Marketing Awards” competition (the “Competition”) which organisations may enter subject to the terms and conditions set out below (the “Competition Terms”).

1. Eligibility and Entry

1.1.The Competition will run from 09:00 on Monday, 11 March 2024 until midnight on Friday, 17 May 2024 (the “Competition Period”).
1.2.The Competition will be conducted in the Republic of South Africa only.
1.3. To qualify to participate in the Competition, participants must meet the criteria (the “Eligibility Criteria”) and:
1.3.1. be an organisation (“Organisation”) registered or operating in the Republic of South Africa during the Campaign Period (defined in clause 2.1.1 below);
1.3.2. be duly authorised by its executives to participate in the Competition;
1.3.3. be represented by an individual (the “Representative”) nominated by such Organisation;
1.3.4. not have directly or indirectly employed or contracted with any of the Judges contemplated in clause 3 for the purposes of the Campaign(s) submitted by the participant in terms of clause 2.1.1; and
1.3.5. not be the holding company, subsidiary or affiliate of an organisation that employs or contracts with any of the Judges contemplated in clause 3.
1.4. Entry into the Competition is free.

2. Competition Rules

2.1. To enter this Competition an Organisation must:
2.1.1. have developed and distributed an email marketing and/or internal email campaign (“Campaign”) at any time from during the period from 1 January 2023 to 31 December 2023, both dates inclusive (the “Campaign Period”); and
2.1.2. during the Competition Period:
    • meet all of the Eligibility Criteria set out in clause 1.3;
    • visit the Competition launch webpage at https://everlytic.com/you-mailed-it/ (the “Website”) for instructions on how to submit an entry into the Competition (the “Competition Entry”);
    • submit a Competition Entry via the Website by no later than midnight on 17 May 2024, which Competition Entry must include, as a minimum:
      • the Organisation’s name and contact details;
      • the Representative’s name and contact details;
      • a description of the Campaign objective;
      • a description of the use of dynamic content and personalisation, if applicable;
      • a description of the industry that will permit a comparison of the relevant benchmark standards (industry and benchmarks can be viewed here);
      • statistics that prove the success of the Campaign objectives, provided by means of screenshots or a PDF report from the Organisation’s send (the “Report”);
      • the Organisation’s motivation for entering into the Competition, including but not limited to, why the Organisation is proud of its Campaign and any notable outcomes resulting from such Campaign; and
    • successfully transmit an email to [email protected] with the following subject line, You Mailed It Entry – [Full Name] – [Company Name] – [Category Entered], enclosing, in a format that will allow the Judges to assess them effectively:
    • a copy of the Campaign email; and
    • a copy of the Report.
  1. 2.2. The format of the Campaign must be in one of the following two formats (the “Campaign Formats”):
    2.2.1. an email message campaign, being the delivery of a message via email; or
    2.2.2. an online newsletter campaign, being the delivery of a newsletter via email.
    2.3. Only one Campaign may be submitted by an Organisation per Category (as defined in clause 4.2).
    2.4. The following will be deemed to be invalid and be disqualified:
    2.4.1. incomplete, inaccurate, incorrect, or incomprehensible Competition Entries or those with invalid links; and
    2.4.2. Campaigns found to be duplicate, fraudulent or that have not been distributed during the Campaign Period.
    2.5. By the action of submitting a Competition Entry, the Organisation agrees and consents to:
    2.5.1. being bound by the Competition Terms;
    2.5.2. receiving marketing materials now and in the future from Everlytic relating to the marketing and promotion of Everlytic products and services, it being understood that the Organisation can withdraw this consent at any time, by giving written notice to Everlytic at [email protected];
    2.5.3. the Organisation’s personal information being collected and processed by Everlytic subject to the conditions set out in clause 6 below.
    2.6. Furthermore, the Organisation shall ensure that it has the consent of its chosen Representative, permitting Everlytic, subject to the conditions set out in clause 6 below, to collect and process such Representative’s personal information for the purpose of the Organisation participating in this Competition.

3. Judges

3.1. Everlytic has engaged experienced professionals (the “Judges”) having an in-depth understanding of effective email campaigns that drive return on investment and the objectivity to score the Campaigns according to a predefined set of criteria (the “Judging Criteria”).
3.2. The list of Judges is published on Everlytic’s website at https://everlytic.com/you-mailed-it/.
3.3. Each participant accepts and agrees that the Judges may have directly or indirectly worked for or with one or more other participants in the Competition in the course and scope of their normal business dealings, but not on any of the Campaigns submitted for the Competition.

4. Judging Criteria

4.1.Each Competition Entry will be scrutinised to confirm that the participating Organisation meets the Eligibility Criteria and that the Campaign(s) submitted by such Organisation meets the requirements stipulated in clause 2. Should any of these requirements not be met, the Competition Entry will be declared invalid and be disqualified.
4.2. A Campaign will fall into one of two possible categories, namely B2C or B2B (the “Category”).
4.3. Each Campaign will be judged by the Judges in the relevant Category, against the following Judging Criteria:
• Creativity & Innovation;
• Impact & Design;
• Content Creation & Relevancy;
• Functionality & Accessibility;
• Objectives reached;
• Industry benchmarks beaten!
4.4. Once the winning Campaigns have been determined, and accordingly the winning Organisation in each Category (the “Winner(s)”) established, the Winners will each be notified by email and a general announcement will be made in late May on Everlytic’s website and social platforms, as well as in Everlytic’s email newsletter.
4.5. Delivery of the Award Package (described in clause 5.1) will be arranged directly with each of the Winners, at Everlytic’s reasonable expense, subject to clause 5.6.
4.6. The Judges’ decision shall be final, and no negotiations and/or correspondence will be entered into after the fact.

5. The Awards

5.1. One prize (“Award Package”) will be given to the best Campaign/Competition Entry in each Category, subject to the clause 4.4. There will accordingly be 2 (two) Winners, one in each Category, and each will be entitled to 1 (one) Award Package.
5.2. Each of the Award Packages includes:
1 x Team Experience Voucher: A value voucher of R2500 per person for the up to a maximum of 3 (three) persons per winner (valid for three years). https://giftexperience.co.za/ To be held in either the Western Cape (Cape Town), KwaZulu Natal or Gauteng. (Travel to the venue is not included in Award Package – see clause 5.6 below.)
For Winners who are not already existing customers of Everlytic:
1 x Free Subscription to Everlytic platform*: Free setup & email credits for a free 3-month subscription, subject to the Everlytic’s subscription terms and conditions (“Free Trial”).
3 x Free Strategic Sessions with Everlytic (one per month)*:Presented by Everlytic’s Specialist and Technical Solutions Manager, providing input into the winner’s CEM strategy during each month of the Free Trial.
5.3. Should the Winner already be an existing customer of Everlytic, the items marked with an “*” will not form part of their Award Package.
5.4. Everlytic reserves the right to substitute the Award Package, or any portion thereof, with any other award package, or portion thereof, of equal value, in its sole and absolute discretion.
5.5. The Award Packages cannot be exchanged for cash, are not transferable and can only be issued in the relevant Winner’s name.
5.6. The Winners are responsible for paying for all their own incidental expenses that may be incurred by them, in accepting and using their award.
5.7. Each Winner will be required to sign Everlytic’s subscription terms and conditions in order to take up the Free Trial.

6. Personal Data and Privacy

6.1. When completing the Competition Entry, each Organisation will be required to provide its trading name, contact details and other information as well as the name and surname, contact details and other information of its Representative. Such information may constitute personal information (“Personal Information”) as defined in the Protection of Personal Information Act 4 of 2013 (the “POPI Act”).
6.2. Subject to the provisions of the POPI Act, the Organisation agrees that, by submitting a Competition Entry and participating in the Competition, Everlytic may, and the Organisation expressly authorises Everlytic to:
6.2.1. collect, store and use the Personal Information contemplated in clause 6.1, to enable the Organisation to participate in the Competition, submit its Campaign(s) and collect the award should its Campaign be determined to be a winner; and
6.2.2. market and promote its own goods and services to the Organisation, subject to the right to withdraw this consent at any time, by giving written notice to Everlytic at [email protected].
6.3. Furthermore, the Organisation:
6.3.1. agrees and consents on behalf of its Representative that such Representative’s personal information may be collected and processed by Everlytic for the purposes and subject to the conditions set out in clause 6.2;
6.3.2. warrants that it has obtained the necessary consent from its Representative in this regard; and
6.3.3. indemnifies Everlytic, its shareholders, directors, officers and representatives and holds them harmless from and against all (i) claims by the Representative or any other thirty party whose Personal Information the Organisation may have submitted to Everlytic, without such party’s prior, informed consent, and (ii) fines as may be imposed by the Regulator in this regard.

7. Publicity

Subject to their right to subsequently decline, the Winners each agree that the Organisation’s name and the name and surname of their respective Representative may be announced in Everlytic’s email newsletter and social media platforms, the Organisation warranting that it has obtained the necessary consent from its Representative in this regard.

8. Disclaimer

8.1. Everlytic reserves the right to cancel the Competition or amend the Competition Terms, including but not limited to the duration of the Competition Period and/or the Campaign Period, and participating Organisations will have no recourse against the Everlytic.
8.2. Organisations enter or take part in the Competition at their own risk and Everlytic bears no responsibility for any loss, damage or harm suffered as a result of participation in the Competition or from the acceptance and use of any award by the Organisation or by any of its shareholders, directors, officials, contractors, agents or other representatives.
